          Attorneys and investigators are often contacted after the vehicles involved in a collision have been removed, debris has been cleared, and the roadway has reopened.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          At that point, the immediate collision scene no longer exists in its original condition. That does not necessarily mean the physical location has lost all potential value.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Aerial and ground-level documentation cannot recreate vehicle positions, debris fields, points of impact, temporary traffic conditions, or other evidence that is no longer present. It can, however, preserve a dated visual record of the roadway, intersection, traffic-control features, surrounding environment, and other conditions that remain at the time of the assignment.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Federal Highway Administration guidance recognizes roadway geometry, intersection configuration, traffic controls, pedestrian features, access points, and sight distance as important elements when evaluating intersections and roadway operations.[1][2] Based on those recognized roadway considerations, American Drone Team’s professional position is that a properly planned aerial and ground documentation assignment can help legal teams understand and preserve the physical layout of a location—even after the vehicles have been removed.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h2&gt;&#xD;
    &lt;span&gt;&#xD;
      
          The Scene Includes More Than the Vehicles
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          The position and condition of the vehicles may be important, but they are only part of the overall scene.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Depending on the location and scope of the assignment, physical features that may still be documented include:

           Vehicle approaches and directions of travel
          &#xD;
      &lt;/span&gt;&#xD;

           Turn lanes, medians, shoulders, and merge areas
          &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;

      &lt;span&gt;&#xD;
        
           Traffic signals, signs, stop bars, and pavement markings
          &#xD;
      &lt;/span&gt;&#xD;

          FHWA’s Signalized Intersections: Informational Guide discusses many of these physical and operational elements, including intersection geometry, lane use, medians, traffic control, sight distance, pedestrian accommodations, and nearby access points.[1]
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Aerial imagery does not determine the legal significance of those features. It provides a broader visual record that attorneys, investigators, witnesses, and retained experts may evaluate within the context of the case.

          Showing How Roadway Features Relate to One Another
         &#xD;

          Ground-level photographs are valuable, but individual photographs may not clearly show how all parts of a roadway or intersection connect.
         &#xD;

    &lt;span&gt;&#xD;
      
          An aerial perspective may help document:

          An overhead image may provide orientation, while ground-level photographs provide more detailed views from selected locations. When used together, the two perspectives can create a more complete visual record than either perspective alone.

          Documenting Sightlines and Physical Obstructions
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Sight distance may become important when a case involves an intersection, driveway, curve, pedestrian crossing, or other conflict point.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          FHWA defines intersection sight distance in terms of the unobstructed view needed to observe an intersection and sufficient portions of the intersecting roadway to permit vehicle movements to be completed safely.[2] FHWA materials also recognize that roadway alignment, vegetation, signs, buildings, roadway features, and other obstructions may affect available visibility.[1][2]

           This documentation does
          &#xD;
      &lt;/span&gt;&#xD;

          not
         &#xD;
    &lt;/strong&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
           establish what a particular person actually saw, should have seen, or could have avoided. Those determinations may require measurements, witness testimony, expert analysis, vehicle data, lighting analysis, reconstruction work, or other evidence.

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

          The role of the documentation provider is to capture the observable physical environment—not to reach conclusions that fall outside the agreed scope of work.

          Preserving Conditions Before They Change
         &#xD;

          Roadways and surrounding properties do not remain unchanged indefinitely.
         &#xD;

          Authentication and File Handling Matter

          Florida Statutes §90.901 requires authentication or identification as a condition of admissibility and states that the requirement is satisfied by evidence sufficient to support a finding that the matter is what its proponent claims.[3]
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Federal Rule of Evidence 901 contains a similar standard. It also identifies testimony from a witness with knowledge and evidence describing a process or system that produces an accurate result as examples of possible authentication methods.[4]
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          These rules do not mean that photographs or videos become admissible merely because they were captured by a licensed drone operator.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          The attorney offering the material remains responsible for establishing the appropriate foundation and addressing relevance, authenticity, hearsay, and any other evidentiary requirements.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;

          The Scientific Working Group on Digital Evidence identifies hashing and preservation practices as recognized methods for helping maintain and verify the integrity of digital evidence.[5]

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          A hash value does not independently prove every fact about a photograph or video, nor does it guarantee admissibility. It provides a method of determining whether the digital file has changed after the hash was generated.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h2&gt;&#xD;
    &lt;span&gt;&#xD;
      
          FAA Compliance and Operational Limitations
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Commercial small-drone operations are generally conducted under the FAA’s Small Unmanned Aircraft Rule, commonly known as Part 107. The FAA requires a person acting as the remote pilot in command under Part 107 to hold the appropriate Remote Pilot Certificate.[6]
